In the movie,the tripods have been here since before man so why wait till now to take over the planet ?  

surely it was theirs for taking back then !? or am i missing something ?

I think the film-makers put that bit in to stop us asking how an invasion force wasn't picked up by satellites. (Not a problem if it had been a period movie).

I think the decision to set the film in the present day brought a number of problems that weren't fully thought out. The main one being that a period movie could get away with some dodgy science and lapses in logic, but a modern piece is less forgiving. Why (from a long list) when the aliens had special implements for digesting and capturing humans did they not have enough data about bacteria to avoid death?

It is just one of several problems with the movie. Why did the aliens not destroy Boston? How did a plane manage to fall from the sky and destroy a house and pretty much everything around it, but not even dent the car? Why can't Tom Cruise act?

good point about the car ! hadnt even thought about that ! i had noticed that the crash site managed to leave a nice road for his car to drive thru !
