can a debt agency write to your employer to get money direct from your wages?
5 Answers
A debt agency has recently been in touch and is demanding to know my employers name and address, this debt has been sold on from lloyds tsb. I am at present paying lloyds a nominal sum every month as advised to do by the cccs. This agency is threating to take me to court to recover the debt.
Can they do this if I am paying albeit a small amount each month ? Thanks

The only way they could take money from your wages is by means of an attachment of earnings order;

I am guessing the agreement you have had in place is with lloyds. The debt agency aren't interested in that. Having bought out the debt they want it now. Not sure why you would still be paying the bank though.
Going down the CCJ route isn't something you want either as it would seriously affect your credit rating. I think they want to know your employer so they can take out an AOE before it got to any CCJ.
I would say an AOE is better because the judge will take into account all your incomes and outgoings and give you a protected amount. CCJ's though can end with the bailliffs. Worst case scenario.
I would certainly speak to CAB. Having them on your side is a big plus.
Good luck.
