hello,

a friend of mine has been told today he wont be getting any money back from a car he purchased that turned out to be cloned.

the person he bought the car off has been found guilty of doing this and many other cars and is currently serving time for the crime.

my question is...... is there any way my friend can take action to get his £4000 back?

well, he could sue for breach of contract

sue the person in jail?
sure, if he has funds.
... i meant if the guy in jail has funds. This might not be the case, of course, but he may still have the £4000 lying around.

ok...is this a matter for the small claims court?
don't know, you'll have to get an answer from someone better trained than me. But if the guy didn't provide a legal car, that's a breach of contract.

ok... thanks for your advice.
Good luck you may get judgement against him but god knows how you'll execute a warrant against him. The guy is in prison so is not employed and I'll be amazed if you can seize any of his goods to satisfy the debt. Don't even think you'll have a cat in hell's chance of getting your hands on any of his savings.....

cheers for that craft....... i gave me mate some advise but i think he has just given up on the money to be honest.... shame really, he is a nice guy, but they often lose out!
