Psychological Violence.

Plans are afoot in France to prosecute perpetrators of 'psychological violence within marriage'. Insult your spouse, and you could end up in Court.
Intruiging - but just how do you prove such a claim? How do you ban such activity? And just who decides what constitutes an insult? Surely proving such misdemeanours is going to be very difficult. And just what would the punishment or sentence be?
I know from personal experience that 'psychological' or emotional cruelty can be almost, if not as bad as, physical violence - but this is going to be a much more difficult 'crime' to prove & Try.
Any thoughts?
