A process server has sworn in an affidavit the he served me in person at an address I had not lived at for over 8 months, and I have three witnesses that at the time of service I was actually 8 miles away from the location in question?

This has been very damaging to me personally as this has led to a solicitor making a false claim about my conduct and credibility in the proceedings undermining me with my own solicitor, my partner and friends. Causing me great stress, so much so I had to commence taking medication again for this.

I now also face a bill for expenses and costs for the case being heard without out me and also the consequences of not being in court to defend myself.. what would you do?

1. Apply for the Order to be set aside.

2. Arrange to swear an Affidavit confirming where you were.

3. Get your "witnesses" to sign statements verifying your whereabouts.

4. Serve the Affidavit and Witness Statements on the solicitor who conducted the legal proceedings. Tell him that if he agrees to set aside the Order, and to pay YOUR costs, that you will take it no further. If not, you will proceed with your Application, get the Order set aside, and then claim all your costs, and the additional costs.
