Appealing a sentence for Drink Driving

My son (aged 21) was recently convicted of DD as he was stopped and tested with a reading of 41 - 6 over limit.

In Court he was handed a fine of £150 plus a 12 month ban commuted to 9 if he attends a special course.

This is a first offence and he is working in a pub/restaurant earning about £120/week.

I do not condone DD at all but my feeling is that he has bee n treated very harshly considering the small excess over the limit.

Does anyone know where one can get sample letters to write and appeal aginst the severity of the sentence?

Well, I am shocked as to what I have just read, " I feel my son has been treated harshly considering the small excess".

Firstly, He should have not really had ANY drink, knowing he was going to be driving, however, he did so, more than 1 pint obviously, and the number of pints he consumed, put him over the legal limit, which he ran the risk of as soon as he picked up the pint. There is ALWAYS the chance of a accident on the roads, as most drivers, and those with common sense know, he got caught, maybe he was unlucky, regardless, he was OVER THE LEGAL LIMIT, it may have been 6mg or 60, still ILLEGAL. Maybe after his driving ban is over, his insurance has rightly so INCREASED, he might regret his actions. How would you feel if another motorist had collided with your Son, example, if he was innocently crossing the road, and this motorist, who was 6MG over the LEGAL limit, had seriously, if not fatally injured your Son? Would you say that any sentence handed down by the Courts was "harsh". I highly doubt so, so don't expect pity, as I for one, will NOT give it to you.

Oh yeah, before I finish, How much remorse is your Son showing? Bet he is more sorry he lost his licence rather than regretting his actions!

really hope you liked your answers and i hope his friends take note of what will happen if they do the same !!!!!!!!!!!!!!! sorry i am not more sypathetic but i think you are pathetic to come on and think your son should get away with it ,i wouldn't take notice of the 1st few comments go ahead and put in an appeal will be the best thing all round !

I don't think your son should appeal. He should consider himself fortunate that while he was driving over the limit he didn't actually have an accident, kill somebody and find himself spending a considerable period in prison, after permanently wrecking somebody's life.
He knows the law. Don't drink and drive. Encourage him to take his penalty on the chin and to learn a very harsh lesson from it.
