i am starting a new job and no longer require a mobile phone contract but network won`t let me cancel without paying nearly 300 pounds if i cancel will i get taken to court if i don`t pay i was recently made bankrupt so not bothered about credit rating etc and live in scotland

if you pay by direct debit take care they will take the money from your bank account
doesn't matter if you're bankrupt - that only applies to the debts you declared at the time. this is a new debt and therefore you will be chased for it.

i`m not paying by dd anymore and i thought that maybe cos i entered into contract before i went bankrupt might change outcome i have asked for my pac code to go pay as go
unfortunately for you a contract is just that - a cntract. Mobile phone companies are not knon for their generosity and will chase you through the courts for this debt. They have kept their side of the bargain and yu havent. Quite often the price of the phone is also factored into the contract
see if you can change the tarrif you have to a lower one.
You cant just get out of the contract.
Were you r new company going to supply you with a phone? If so, talk to them and see if they will allow you to keep this phone in lieu of theirs until you can legally get out of the contract to help you avoid getting into trouble, and claim it on expenses.
ive had a contract with voda, orange, t-mob, 02, 3, virgin mobile, phones4u and all the bill's have been £300+ a month, ive never paid any of these, have been mithered once via letter and thats it, none of them bother so as long as you instruct your bank not to allow the network provider to take money from your account you shouldnt have any problems.
Trading standards- (number should be in the phone book), are bang up to date with your rights. I once contacted them for a similar reason. Like has already been said; a contract is a contract. you will have to pay the basic monthly charge x the number of months left on your contract if you want to cancel. I just stayed with my original network and paid my tariff.
You can usually drop to a lower tariff after 1 to 3 months into the contract- depends what network you are on.
