insurance refusing to pay out- Help!!!!
my mums car was insured for any driver, however my sister sadly wrote it off 2 months ago, apparently though, because my sister did not disclose (even to us!!) that she had a conviction and points for no insurance previously, the insurance are saying that the policy was void and the car was unisured, they have basically said that my mum is also responsible for all of the costs involved in garaging the car for the past 2 months also!!
am i wrong in thinking that because the insurance was for ANY driver, then if the driver didnt disclose any points/convictions to the vehicle owner i.e. my mum, it wasnt my mums fault and she would be able to get at least a little of the money back on the premium that she had payed??
I dont know how these insurers work, if you are insured for any driver, then are you expected to ask any potential drivers if they have a clean licence then if not, have to name the driver before they drive the car and forewarn the insurers about their licence????
My sis has cost my poor mum a lot of money and upset, so if there if anyone out there who could possibly tell us if we can salvage anything from this mess then i would be extremely grateful!!!

I was under the impression that an any driver policy meant that you could let any driver with a full uk licence to drive the vehicle, i didnt realise that it meant any driver who had no convicitions/points and i didnt realise that you had to let the insurers know who is going to be driving your car on any particular instance, if that was the case then what would be the point of any driver, would it not be better to just have named drivers on the policy??
well i suppose that if she can get her policy premium money back then thats a bonus as she had to keep paying her monthly premiums throughout this whole claim scenario!!
