Common Assault - URGENT CHARGES ASSISTANCE
My friend (F) left their partner (P) last year due to P committing adultery, stabbing & in past hitting the kids. This was all captured on voice recording which was discreetly obtained. Understandably F couldnt take this any-more. which is why they left marital home. F has been controlled over years by P, who is a very manipulative person.
Over the past 6 months F has taken abuse after abuse from P & as a result F has not been able to properly get on with their life. Their children have been at the brunt of it all & even at times P used the kids as a weapon, knowing this would hurt & get to F.
The other day F was asked to meet P as P was dropping items off at F's rented house. Whilst here there was a disagreement over the keys for the marital home & P then pulled out the spare car key they would have picked up from within F garage. P then keyed F's car, which F asked why. F then started to record everything on mobile. Only a small part was recorded, which does show P lungin towards F trying to get their mobile phone which P had picked up off the floor and used it as a bargaining tool to get the car key back. Prior to this the recording shows P driving erratically with a child in the car, no seatbelts. During a scuffle both P & F and the child fall over. P then knocks F mobile out of hand. Prior to falling over F is trying to push P off in self defence, F gets cut hand as P tries to get the mobile from F pocket. The problem is that although P made a statement to say F tried to strangle them, the middle of the arguement was witnessed by an independant witness who from some distance said F got P by back of neck & pushed them to ground, which they wouldnt have been able to see from a distance. Apparently P doesnt want to press charges but F has been charged and bailed for Common Assault. Please can someone comment for my Friend? Thanks
