driver reversed into me

hi all
need your help on this one
as i parked up next to a shop, i turned off my ignition, put the handbrake on and the car that was parked in front of me, put his car into reverse and reversed straight into the front of my car.
he got out of his car, as i did, and said to me " did you not see me reversing?" i answered you wernt reversing when i parked up!
he is now trying to force me into going thru the insurers to get the work done to both our cars, he has a cracked rear bumper and i have damage to my grill and scrapes to my front bumper.
i have told him in no uncertain terms that i refuse to go thru the insurance and lose my no claims for something that isnt my fault..
he then said to me as i understand it its your fault cos you went into the back of me, he just doesnt understand that i cant have gone into the back of him when i parked two metres away from him and my engine was off and my handbrake on!
i have already lost my no claims bonuses twice because of other drivers hitting me and i dont think its fair to have to cough up £400 quid for something that wasnt my fault and lose my no claims bonus again!

You may not lose the no claims bonus if your insurer recovers the money from the other driver
I completely agree with you, its not your fault, the same kind of thing happened to me in december, i pulled up behind a van on my moped and the van reversed and knocked me off, i claimed on his insurance and won the battle! :-) in your case, the other driver should have checked his mirrors before reversing! you are not in the wrong.

thanks for your quick replies.
i am adamant i dont wanna go thru the insurance, i just dont think its fair to lose my no claims bonus again plus we are in the middle of renovating our house so i just dont have the £400 excess to hand over in the hopes i may get it back.

ive had a no fault claim recently and i wont lose my bonus, didnt have to pay anything out, and it wont affect my premium either.

I have something called angel cover with my insurance, it means i dont have to go through my insurer, just use the legal cover part who dealt with the other partys insurance for me. I even got a hire car whilst it was being repaired

so much easier. May be worth you checking if your insurer offers the same thing when you next renew.
I dont think you have any choice whether to go through your insurance or not if he wishes to. It sounds dodgy that you dont want to, to be honest. My first reaction to someone saying that would be that they had no insurance.

Unless you have a witness this might, at best, be a 50 - 50 claim. Can you prove he reversed in to you and it wasn't you driving in to him? Without any witnesses I think you're stuck.
