Tax credit and CSA
3 Answers
Hi I am new to this site and have 2 questions that I need help for I promise will try to explain past as shortly as I can;
I have been with my partner for 5 years we both have a son each from other relationships
my son has no contact with his father nor do I receive any CS for him (better this way)
my partner before we began our relationship had his son 4 nights every 2 weeks and paid CS of 20% of his wage. when we got together after a year we introduced the kids and his ex (although was only together on 2 occasions but as he says has a wonderful son from it) stopped all his access completely this went to court and he was given access every fortnight and the judge also said eventually we can let the children see each other can I please add the children had no problem with each other or each other parents partner it was just his ex being a pain!
Anyway we would love to move in together we will have to go to court to sort all this out again all I need to know is
I work part time and receive some help towards rent and child tax credits when we move in together obviously all help will stop so
will the CSA take into account my wage on top of my partners wage (he currently pays her and keeps records but we know she will go down CSA route when this all happens although looking at it she will prob be worse of from now)
also will tax credits take into account that my partner pays maintenance for his son
any help will be great thank

Your income should not be taken into account by the CSA but it is possible that any Working Tax Credit or Child Tax Credit might be.
I don't understand why he is paying 20%. If there is only one child it should be 15%.
Whether tax credits you get now will stop will depend on your joint income. In any case, it is absolutely vital that you let the Tax Credit Office know immediately you move in together, and end your single claim. You should then make a couple claim to see if you do have an entitlement.
