Paid a deposit but dealer wont refund even though I have in writting it is refundable
I paid £150 deposit via debit card to a car dealer who gave in writing that it was refundable if for any reason I was not happy with the car. after a rude email from the delear I decided not to purchase the car and asked for a refund. after no contact for a few days I sent an email stating the legal actions i would take to recover the money, when i got home there was a telephone message to ring the dealer, I did so but after asking if the dealer would refund my deposit he began to swear shout and say some nasty things to me; "he said he could sue me for the full ammount" and " that I had lost my deposit" . The dealer then put the phone down. 1. can the dealer sue me for the whole ammount ? 2. Am I entitled to get my deposit back thanks? 3. if so can I also claim the expenses to do so from the dealer. thanks

if it does then write to dealer giving 5 days to refund the money. State that you shall take it to the small claims court if they do not refund.
Obviously you have to be sure that what they put in writing stands for you changing your mind.

As long as the car wasn't damaged - I don't see why you can't have your deposite back. Go to the citizens advice, i'm sure if the car WAS damaged he'd sue you for it. this might make interesting reading for you:
