Distance buying of plants

My elderly neighbour ordered some plants from the internet after seeing them advertised on a tv shopping chanel. It said the items would be delivered within 7 days however when a confirmation of the order was sent it had a sentance at the bottom that said that due to the time of year they may take up to 21days. The 21days came and went so he decided he didnt want them anymore as it was getting a bit late to plant them so I sent an email cancelling the order. I got an email back ignoring my cancellation and saying we apologise for the delay your goods are now packed and we will let you know a delivery date when we have one. They then attempted to deliver and the items were refused by my neighbour. Today another small package was delivered through the post and he handed it back to the postman. We are talking about £70 worth of plants so can anyone tell me is he within his rights to cancel as it was outside of the delivery time?

Absolutely, I kept complaing and finally got my money back.

Thanks for your support carlton 23. I will keep going on his behalf . Hes 82 with no familly so I like to make sure he is OK and would hate him to lose his money.
