As a general rule, if property has been stolen, the original owner or their insurance company have a better title than an innocent purchaser. However, this does not apply where deception has been involved, and may not apply if the property has been added to or altered since it left the original owner’s hands.
Proceedings under the Police (Property) Act 1897 may be taken in the Magistrates' Court.
Complicated cases may be referred to the County Court (for property worth £30,000 or less) or to the High Court (for property worth £30,000 or more).
