neighbour from hell........

my front garden has a lawn with a flower bed seperating me and next door..today the man with a can of beer in his hand went outside and rotavated his side and one foot of mine..turfing up flowers i have grown from seed for two years..i was devastated and could not eat my dinner..tommorow i shall get a fence marking the boundary..i have had lots of problems with this neighbour including fetching the enviromental health in..for his noise and nuisance..which isnt so bad now..but he still has his moments..i am a peacefull person and hurt no one i make as little noise as possible keeping my stereo as far away as possible..i dont slam doors and my dog is under control and reasonably quiet..he rarely barks..the opeople next door are of a religiouse group that knock doors and i wont have nothing to do with that allthough they constantly send the elder from their church round to try and save us we tell him to get lost ..not interested..how many other of you have neighbour complaints??thank god for answerbank as i was crying earlyier about the loss of my plants now i am steaming mad..

For more on marking an answer as the "Best Answer", please visit our FAQ.no i didnt know their was one will have a look..i dont think they are criminals next door but a nice way to describe them would be trailer trash..have been looking at to much american tv have picked up phrases..they came off a rough council estate to a quiet residential area and bought bad behaviour with them..mr daisy said we cant move for 3 years ..so i am not happy..

smudge thanks for the post..i think i am going to remove the rest of my plants from down the centre ..before they get hacked..unfortunately we have to stay here for another 3 years until mr daisy retires ..and then we will leave the area..thank goodness..i guess if i get someone to fence the boundary off then i shall have to remove my plants as they will dig them up..putting fence posts in..i had also planted lots of seeds and they have been churned up also..oh well i guess its done now and all i can do is move whats left and keep it bare..until i can get a fence sorted..
Aren't there new laws regarding trespass? It will be a criminal offence from now. Perhaps a legal eagle could advise as to when the legislation starts. It is due and is part of the last lot of los of civil liberties stuff. I think the law is intended for use against hunt saboteurs and right to roam people. Now that could work in your favour, because a law is a law whether it is a big aristo estate or whether it is your garden. Trespass used to require a civil suit, Also, there are ASBOS powers a local Council has now. You ought to make a note of any incidents - date, time, etc.
Come to think of it was he ejected from that estate because of an ASBOS? I have often wondered where they go next and pity the souls who are going to get them. The problem is moved on but to ....previously quiet residential streets. Does he own the house I wonder? Perhaps a Council (the same one?) is still his landlord? Make sure any fence is just within your boundary as if he bashes the fence in the future it would definitely be trespass which could be proved.
yes he does own the house its a quiet area..or was..and you are right their is no fence down the middle so as he is thick he probably would have said he didnt know where the boundary was..our house comes with mr daisy job but i shall be onto the surveyor as soon as he gets in work this morning and he will have to put a fence up..i have been awake since 0230 thinking about it..its the first time he has done any weeding down the middle bit in 7 years ..and he still didnt bend his back he had a rotavator to do it..i wish we could just move but we have to wait till mr daisy finish his time..well i am off now to bend the surveyors ear..
As a keen gardener oxeyedaisy I really feel for you. I would cry too if somebody wrecked my garden & then, although I very rarely 'lose it', I'd probably go berserk. Sorry I don't know what to tell you on a legal basis but I would get some kind of boundary in asap. In a few weeks there will be some bargain plants to be had (hopefully), & I know it might not be what you'd planned but maybe you will still be able to have a lovely border this summer. All the best.
have been in touch with the surveyor and he was cross also..he is going to get the boundary measured..they wasnt bedding plants they were things like bergamot and seeds that hadnt had time to germinate..and a passion flower that was crawling up my tree..he ripped that off..the tree isnt on his land or overhanging..i wont be putting anything else their till the surveyor gets it sorted..the man in question came from a rough council estate and bought the behaviour with him..i could buy this house but who wants to live next door to someone like him for ever..
Well hey at least your neighbour bothers to do his lawn etc. sorry to be blunt, but our nextdoor neighbours never bother with their garden ever at the back, their front has got gravel as they probably had complaints or something but there back garden is an overgrown jungle they cut there privet hedge once a year while we keep ours trim so we get this mass growth on one side they are lazy gets and they smell humph rant over!
Sounds like the surveyor will sort it out Get him to underline the points of trespass to you for future reference. Anything cut down on the neighbour's side but which belongs to you has to be brought back to you. That happened to my ma once, when she trimmed a lazy neighbour's privet. We had a solicitor's letter about it and my mum had to take back any privet cuttings and put them on the neighbour's doorstep!
Not much comfort if plants are uprooted, but you are entitled to them and perhaps the cut flowers would have been nice.
