First time offence..Outcomes?

im on bail for 1 count of assault after i punched a girl and one 1 assault section18 when i smashed a glass over my ex patrners head.. i have never been in trouble before..will i go to jail?

I am going through this with my son who was attacked and defended himself and ended up charges with section 18. It has been the hardest time of our lives. Like others I too am going through this, my partner up for two counts of gbh with intent. Your sect 18 is serious, i would think that cps is looking at what to charge you with. It is very serious, once or if charged seek good council, the fact that it is a head injury isnt good, drink is no excuse, you are still on bail , first time offence starts at min 4 years in this case, unless there are mitigating circumstances i think you are looking at a custodial sentence, I do wish you well. There is no minimum sentence to the charge of Section 18 GBH anyone who tells you there is a minimum of 4 years custodial sentence imposed is someone who knows very little about the subject. I would further suggest, to everyone, that seeking the advice of a police officer as to sentencing laws is not recommended. if you feel unsure about the advice given to you by your Lawyer or Counsel then ask them to explain it in more simple terms. Dont feel embarrased to do this as its their job and evidently thus far they have not carried out this aspect of thier job to a proper standard. Good Luck.

Sentencing guidelines are that 3 years should be considered a normal sentense for deliberately wounding with a broken glass or bottle

Whether or not that is relevant depends on the exact nature of what happened - if it just came to hand that is different to something that you deliberately picked up for example.
However although the Judge is not obliged to stick to these if the sentence is thought to be unduely leniant the prosecution can appeal the sentence.
