Getting rid of Trespasser..... HELP !!

Does anyone know how I can get rid of someone who frequents my land without permission,without risking reprisals such as vandalism?

I am sick of a bloke who keeps using my land to store his junk. He used to keep a horse on the land but doesnt anymore but seems to think he has a right to still use it. He pays no rent.

well you might not be able to get him on trespass, even though it is illegal, but if he is dumping stuff there he might be committing a nuisance

I would suggest that you see if any of your local solicitors do a fixed fee interview to determine what your next step could be

phone the police and tell them that someone is flytipping, once he gets upto �1000 fine and the threat of imprisonment he is likely to not want to do it again!

I am tempted to get his stuff together and take it all straight to the tip but then I would be in the wrong then I think... If I change the padlock on the gate, I know he will just cut it off and carry on..  I have asked him by text to remove all of his belongings but he is just ignoring me  AAAAaaagggghhhh !!!

I would personally just dump it after giving him some notice.  But thats just me - I have no time for freeloaders, gypsies or anyone on my property.  They should pay their rent and/or taxes etc like everyone else.  When they've payed it they can then have the same privilages as the rest of us.  Unless they are physically or mentally proven unable to of course.

But a safer approach maybe to ask the advice of your local police as he is after all trespassing.

I have logged a complaint with the police already as he threatened to burn my stables down, that was last weekend. They said they would arrest him but I dont think they have bothered.

Just place his stuff outside your gate/ land and if someone happens to help themselves to it, it his fault not yours.

If you put a new lock on your gate and he breaks it then you can get him done for damaging your property.

Thats what I am tempted to do... change the padlock, but I know he will cut it off and leave the gate open. I will get a few padlocks and keep changing then til he gets bored with cutting them off. He has a horse trailer and a caravan ( which he lived in till I told him to get not to) and a couple of canoes on the land plus bits and bobs that I can take to the tip. Am I breaking the law if I take his bits to the tip without his knowledge or permission, If not, I will take some on Sunday !??? I want him out !!

Don't take his stuff to the tip, as he can get you done for getting rid of it. Have a word with citizens advice.

Do you know where he lives? because you could dump it all outside his front door.

He was renting a room from a bloke down the road but I think he may have been kicked out by now. If he has no address, surely a solicitor wont be able to help me? I told the police the address that I thought he was at but if he isnt there then he wont have a clue that he's been reported?

Just a thought, let him stay but start charging him rent. Obviously he isn't going to pay, but the more of a debt he builds up the more power you would have to act through the courts, and with the help of the local police and baliffs, finally get rid if him.

In the meantime wouldn't it be a shame if some un-seen local yobs smashed up or set fire to his stuff! (without your knowledge of course)
