Do i need permission to take son abroard ??
My son is 4 will be 5 when we plan to go away... His father is on his birth certificate.. I have Full residence.. Also have in place at moment.. Non-Molestion Order. Prohibated steps order.. He isn't allowed contact with myself.
He was given access in a court hearing in june this year which lasted one session before he threatened to abduct my son.. History of violence and been charged with abuse on myself etc. Access is now completely stopped and I wont be re-instating it either.
Now me and my mrs wants to go abroad next year.. Do I need his permission to take my son abroad ?? Or legally am i ok to take him wihtout notifying his father.. who has no contact what so ever now thorugh solicitors letters.
Any advice greatly received

For more on marking an answer as the "Best Answer", please visit our FAQ.Since you have a residence order you're entitled to take your son out of the country for up to one month at a time without his father's consent. (If you'd not got a residence order you'd need the father's consent, even for a day trip abroad with your son).
If you try to take your son out of the country for longer than a month (without his father's permission) you'll be committing a serious offence under the Child Abduction Act 1984.

Hi, I am sure that you need the other parent's consent, as both parents' names are on the birth certificate you both have parental resposibility. You need to read the relevant parts of www.adviceguide.gov.uk which is the publics' website containing all the information that can be had by going to Citizens Advice. When on the website go to the relevant section and ask your question, or look at the FAQs. for that section.
