dealer wants his car back?!

hi i bought a car from a dealer and part exed my old one towards the cost. a day later he rings me and says there is a gearbox fault with yours so i would like my car back and you can have yours. he didnt take mine for a test drive before so that is his fault! can he ask for this car back or is it legally mine?

It's not his fault but try boot on other foot? Would he swap back? No way Jose!

It's a grey area but lack of lemon laws work both ways.
i'd tell him politely to take a running jump, usually a dealer gives a price after test drive to make sure it's ok, would you buy a car or p/ex your car with a new car without a test drive!!! i don't think so.
i would threaten to report him to trading standards and police for harassment if he doesn't stop pestering you.
ah but did you sign any paperwork suggesting that your car was in full working order, knowing that there was a gearbox problem?
He is the car "expert" yes ?

the dealer has to determine what price he's giving fot the p/ex and what faults there are, also you also are determining if the price he wants for the car is reallistic, and also what faults there are.
could he be a bit dodgy and in fact have scavenged good parts from yours, replaced with rubbish ones and hope you wont have a clue?

id say no to him...the deal is done - caveat emptor...buyer beware...

yeah i suppose but i need to go back to see him to give him the v5 for my old car (was retaining the number plate but he said to give papers when they arrive) and im a little scared!! lol
do you have the registration documents for the new car and a reciept?

yes i have both receipt and the v5. good idea r1geezer!

yes. What business man buys a car without seeing the v5 anyway?
Do not communicate at all, just send what you need to by registered post and leave it at that. Believe me if the boot was on the other foot, hell would freeze over before he'd reverse the deal.
Seems like he had the change to mitigate any potential loss by doing a proper inspection, test driving etc...

I was going to ask the same as redcrx, did you say or write or sign anything suggesting there wasn't any problem? Anything that could have misled him?

I don't have any idea what a V5 is though in case that answers my question.
V5 is the logbook...
