Smoking in work van.

My husband (who is the only non smoker out of all his colleagues) either drives or gets picked up in a work van. His boss is often in the same van and him and all the others smoke constantly all the way to and from the job which can be nearly 3 hours each way. He stinks, his eyes water and worse still in one of the vans the windows are broken so they cant be wound down and they all still smoke away. I would presume they know they are breaking the law but they dont care and refuse to stop. Is there anything he can do? He doesnt know who to report it to but if he did they would know it was him. Any suggestions?

My 'ball & chain method' might work, and it's very subtle.

You get a 6ft steel chain with a spiked metal ball on the end and swing it around your head as fast as you can.

it is against the law to smoke in a works vehicle..but how to police it ?? without recrimination it would be difficult...could he tell them he has a medical condition which they are not helping and to stop for a smoke en route ?

How about, "if you don't stop smoking in this vehicle, you'll have to subsidise the use of my own vehicle''?

Quite honestly, he needs to be upfront about it and tell them that if they don't stop he will have to take some legal employment advice. He can hardly be sacked for this. I would rather antagonise my colleagues than have my health compromised and endure the constant smoke. More fool his boss, he is the one who is at fault for letting it happen and he is the one who will have to pay the consequences.

His boss is a total w@nker. If he found out my husband had reported him he would probably sack him! Its just a disgusting situation.

whats the job? do theydeal with customers directly? could a "customer" call and make complaint

No unfortunately there is no one else who could report it. He works in construction so you can imagine, the majority of them smoke! They have to travel all over the country to work whether it be 1 hour or 6 hours in the van.

Get your husband to phone ACAS and discuss it with them. We have found them extremely good.

tell him to put some fear in them..develop a cough...use ventolin in front of them...then on eday fake an asthma attack whilst in the van...make them take him to the hospital...

next time hes in the van he should casually say it was because of the smoke...but not kick up a fuss...they will probably wait...

if he causes any fuss they will probably turn o him and make him want to leave anyway

This is exactly why the smoking law was introduced, smokers are incredibly selfish and would never put their own house in order. How many times have you seen a private car with a kid in a safety seat getting gassed by both parents in the front? you're nice and safe if we crash but in the meantime here's some cyanide to breath in, what parent could do more?! They don't care about their own children For Funks Sake so it's no surprise that your hubby is getting gassed too. Tell him to get one of those turbo water pistols and extinguish them!
