What dooes your contract say about what happens when there is no work?
Question Author
nothing at all
dont know even if we have a contract now as used to get payed from a wages company but not now but have not had new contract but never told or informed about any of this
Sorry I don't understand this.
Have you asked your employer why you haven't been paid?
When you say you are PAYE do you mean you are on the payroll?
Unless you've got a 'zero hours' contract (where you only get paid when you're required to attend work), you should still have been paid while you've been laid off. Further, you've now reached the stage where you can apply for redundancy pay.

It's all explained here:

I don't understand how this situation has arisen. Were you sent home from work one day? Did you get a letter saying don't come in? Was nothing said about pay, giving notice or redundancy?
Question Author
i work as a contractor and after my holiday i was ment to go back to work but the jo got put back and they would call me
the other lads worked in the wearhouse on half pay for 3 weeks but i was not asked
i got a letter of them saying that they have layed me off but i asked for that to give to my creditors
So were you regarded as a self-employed contractor rather than an employee? Or did you work via an agency/other company?
Had you been working exclusively for them?
If you were a contractor what terms were agreed and did they cover this situation?
Question Author
no i was employed by them on paye use to work avarage 70 hours a week but we only got payed for 40 hours when on holiday pay
when i say i was a contractor i meant i was in the building game
i still have my contract but it dont say anything about holiday or pay for no work or lay offs
Were you given any notice period and were you paid for the notice period.
What notice period did you think applied? Were terms and conditions never discussed or written down anywhere in the ten years you were there?
Have you aske dyour employer for written notice and confirmation of whether you have been made redundant
Question Author
no as far as i am aware my first contract still stands as i have not had any thing to say differant,
i have a leter of then saying that they have laid me of while trade is bad but i asked then to write that so i could send it of to my non paid bills
can they just say you are employed by a wage company then back to them and not say or do anything about the old contract?
i have not signed a new contract or been able to descuse one
Phone ACAS, they are very helpful.
Yes try ACAS, or ask your employer. I can't help any more because I still don't understand what you are saying about who employs you and what your contract says, sorry.
