How is my birth certificate name different to my passport name with no legal change?

Me and my partner are getting married abroad and whilst sorting all the paper work out I noticed that his birth certificate name is different to the name on his current passport. Ive sopken to him and his mum and neither of them believe his name was changed legally so how has he got the passport in the first place and what am I going to do now with regards to proof of identity?
The wedding co-ordinater needs birth certificate, passport and if differ in names then a deed poll. Arrggh!

Well I'm sorry, but on a question board where there are several legal experts, not one of them has bothered to answer your question properly.
I was given my natural fathers surname on my birth cert. my mother then remarried when i was 3 years old and I took my step fathers surname, I was then known by that name for the next 40 years, my passport, driving licence,...

If just a slight spelling change then could simply be an administrative error by the passport office? Should get them to correct it. However, depends on whether he agrees and which is the spelling he uses in the rest of his dealings e.g. bank etc. If he wants he could just change by deed poll - no big deal - just do it online and only takes a few days. However if it's a completely different name altogether like John instead of Anthony or Smith instead of Allen - I would be suspicious.

At no time was it changed by deed poll. I was married twice, and all I had to do was state that my name was ........formally .........
When my 3rd partner and I decided to get married in the Dominican Republic, because of the different name on my birth certificate, I had to get my name legally changed by deed poll to the name I had been using since being a child.
It took 1/2 hour at a solicitors and costs about £75.
Ignore all the comments about being suspicious, they are ridiculous, and posted in ignorance of the law.

MY son took my husbands name when I remarried.He was eight years old and he has used it ever since.It was never legally changed so there is no documentation to show.When he applied for a passport in his twenties all I had to do was write a letter explaining the circumstances behind the name difference from on his birth certificate.He got his passport no bother !!

Thanks EuroAnchor, I wasnt suspicious in the slightest as I knew he had a different name at birth, he like you had his fathers but when he started school he started using his mothers name, I just thought he would have had to have it legally changed in order to get a passport.
