How do I get a partition order (tennants in common)
Can anyone advise me how we get a "partition" order to enable the sale of our house.
The houes is held in a tennants in common agreement (45% me, 45% my wife & 10% my deceased mother in law). My mother in law willed her 10% to 8 of her 9 children, discounting my wife, meaning 8 of my inlaws own 1.25% of our house each.
We have come to an agreement with 6 of them to purchase there share, 2 of the inlaws are refusing, insisting on keeping there 1.25% (they are being spitefull).
we want to have full control of our house & would like to know how to force a sale, also could we sell the house to ourselves?
Sorry about the long post, but this has been dragging on for months & is causing nothing but upset & heart ache.
