If an item is purchased brand new and never used, at what point does it cease to be "new".
Can it be claimed that the item is "new", if it has been unpacked, but never used.

Edd, I use ebay all the time but not as a seller. There are many 1000's of sellers who still use 'as new' etc in the title regardless of the section they put their item in
We have all assumed West is using ebay (I think) but as he hasn't come back to us with any answers we cannot know for sure
