friends mot ran out on the 11th jan 2011, which she only realised on saturday (she had been looking at mot cert for her previous vehicle which would of ran out in july2011). she has now booked mot for monday but had to go to see her dad who has come out of hosp after having a heart attack. on the way she passed a mobile speed camera whilst driving about 35-36 in a 30. There were cars coming both ways and police van was parke on opposite side of road. There were cars in front and behind her all keeping at same speed. now she is worried she has been caught speeding as well as checking her mot, this is the first time she has never had a valid mot cert. what will happen if she has been photo'd. thanks

The table provided by “Law on the Web” is not particularly helpful as it provides only the statutory maximum penalties for each offence. Few people receive the maximum penalty for motoring offences (or indeed most other criminal offences). The most likely disposals for both the offences you describe are fixed penalties. These are £60 plus three points for the speeding and £60 with no points for the MoT offence. However, it is unlikely that, should a fixed penalty be processed for the speeding that enquiries will be made to establish if a valid MoT was in force or not.
