common assault of a police officer: will he get a custodial sentence?

my partner was dragged out of his car by police officers, he resisted arrest as they did not tell him why they were doing so. he was pushed onto the floor by two officers and was taken to the station.

He was charged with two assaults on both police officers, driving without a license or insurance. first of all he has a license and insurance. when he attended court they threw out those charges, but persisted with the assault charges. he has to appear in court at a later date, what is the likely outcome for this case?

If the police have treated your partner in this unfair way and have in fact assaulted him. I would seek legal advise and file a complaint against the police involved in the incident.
Take it all the way.
This is not a third world country (Not yet anyway !) and having an honest police force with integrity keeps up us this way.
Let us know how it goes.
He will plead not guilty, I take it ?
If you put such an unlikely story on the answer bank you have to expect that people will question it or not believe you. This is exactly what will happen in court. The best thing your partner could do is plead guilty and then he will receive a lesser sentence than pleading not guilty and being found guilty. I think that the guidelines for sentencing are prison.
You just want to hope that I am not on the bench.
As for you being stressed, well with such an idiot for a partner I'm not surprised.
As for me being ignorant, I can live with that because I am not going to prison.
All the girl wanted was an answer and some of you took it upon yourselves to judge and for whatever reaosn try to argue with her. I have never been in trouble with the police in my life and I saw my boyfriend be assulted by 7 officers when all he was doing was making a complaint (he in the past has had run ins with the police but is now working and leading a normal life and has been for many years) and now somehow he is going to court for assult on four. Now I was also there making the same complaint and they did not lay one finger on me. Officers abuse their power and I have witnessed it for myself. If police want to get somebody then they will lie and make up any story to get them sent down. I will let you know the outcome in court.

Thank you to the few people who understood my problem with the police.

To everyone else who thought my partner was a to blame for their attack on him, i would just like update you. medical reports taken by the doctor after the attack, showed that the police had no form of injury not even a scratch. however my partner had a whole list of injuries (which will be claimed for). the case was thrown out and was a total waste of time and energy. this highlights your ignorance, and i strongly advice that you wake up and notice what happens around you.
Well done manie - ive been assaulted by police - they think they have the right to do what ever they please. When i was assaulted By them i did not fight back at all - it is de-humanising and demorilising that just because they ahave a uniform on you have to take being kicked stood on, kneed and punched without the right to respond or defend yourself. The individulas in here have no perception of police behaviour - but be warned it may happen to you as it did to me - and yes I was doing nothing wrong at all, was beaten and then charged with assulting them!

I understand your husbands point, I am being charged for assaulting a police officer after he gabbed my arm from behind. I turned and put him in arm lock as a matter of self defence. this was just an automatic reaction, without realising he was a police office. I let go immediately and gave myself up as I knew he would arrest me. And apparently I knocked out his contact lense..... this was the assault. Now it seems as though there was no cctv evidence from a camera 10 yards away, the paper work from the police station seems to have gone walkies, the arresting officer described me as wearing sage green I was wearing brown, and he felt I was part of a rowdy group........ there was only my friend and I celebrating my birthday....................

In my experience some police seem to be lying thugs, who abuse there position, resulting in the FACT that very few people seem to have respect for the police any more.......... that's a real shame for those who do there job properly.

The reason that they would have used to drag him out of the car, is as the blogger said earlier is because he stretched for his documents.,rightly or wrongly.

They can and will use the law to abuse, and is all they need to suggest is that your partner stretched over the passenger side, and they thought that he was grabbing a gun or something. that would give them cause to treat your partner how they wish.

Unfortunately, your other half wont have a chance, furthermore I doubt I will either.

The video prior, prove that the police have as many institionalized thugs, and they had racist 10 years ago, before the Lawrence enquiry.

I just got then end of teh post and saw the good news...... its a good job ethandron weren't on the bench as i would love to believe our judges aren't so prejudgmentle.

This is the “normal” behavior of the British police if you are arrogant or you answer back at them. This are the type of people that join the force. Overpowering arrogant and overzealous people. I was stopped many time by the police and I was normal with them and answer all their stupid questions about my school and fun and all that, and they did behave professionally.

But the last time I was stopped was in a train station, and they came to me and one of them asked me my nationality, and I thought that is a little bit to racist and xenophobic to tell. Being a foreigner from a country that British people (racists) don’t like that much. Just because I did not tell them my nationality they immediately grabbed my both hands and they told me that I am under ARREST under the terrorist law (which was illegal of course). Actually I wasn’t properly arrested, they ware just trying to scare me and keep telling me that I should be nicer with them and tell them my nationality. Eventually I told them my nationality and after they found out, they searched me for more then 30 minutes even if I had almost nothing on me, they just kept me against my will next to a wall, pretending that my bank statements where so important, that they had to ask: WHAT IS THIS SIR ?.

Next time I will answer their questions, but I will lie as much as I can, like a criminal, just so I can feel good about playing with them, just like they played with me.

hi i am not being funny but i see things from all perspectives and to turn round and join groups like we hate the police or police hate campaigns is totally rediculous and giving the the wrong signals out to younger generations. there are some police officers that do abuse their power it has been proven however you can not tar all police officers with the same brush. (and i have seen an assault by an officer and when i protested about this i was arrestedtoo) however our police officers have a very hard job to do and with the current goverment cut backs this can only get worse and frustrating for police, answer me this if you all hate police that much and dont trust them who would you call in an emergency or god for bid you were being attacked would you not want them to come to your aid. i know i would . i understand the womens concerns and she should have just been given an answer but if you didnt want a debate the question should have been what could happen to my partner if he gets convicted of assaulting a police officer. not the whole story of why he did it. because the only people that know what went on that night are the gentleman and the police.
