Falsely accused of sexual abuse!!!

I was recently accused of sexual abuse towards my now sperated ex-wife in a family court whilst in a residence hearing for my children. She told social services and her lawyer I had commited this act and it went in the CAFCAS report. She then admitted to her lawyer that she had lied about this abuse.

Can I have her charged criminally?

I would imagine yes but what she has done would also give you significant leverage for your children.
sexual abuse toward another adult? you mean rape? or sexual assault?

were the police involved? what evidence do you have of her allegations, and confession of lying?

Sara3 - She accused me of sexual abuse towards her. She told her solicitor and wearside women in need ( a help line for women who have been raped )
She accused me of this in a family court, then later confessed to her solicitor it was a lie as I told her her how serious making false accusations like this could be. The police were never involved as she could not prove it, as it never happened.
If she admitted it to her lawyer, whilst I am not doubting your word I'm not clear how the information got passed on to you .
I'm with Factor on this. How did you come to know this?

Wow, have done as Eddie suggested and can only sympathise will all involved.

Your wife must feel, well I'm not quite sure but certainly let down, humiliated and quite possibly disgusted with herself. I'm not saying for one minute that makes what she said untruthfully right, but please, even you must understand why?

I am a huge advocate of children having contact with their father, even the abusive ones (in the right conditions) BUT your children must be extremely confused and hurt to the point that no one here can possibly understand. This is a particularly unusual situation for all everyone, and one that has left everyone, including your wife, reeling.

It is easy to say, but if I were you, as there is no police involvement, no investigation at all carried out, I would think very long and very hard about bringing any charges against your wife. Consider only what this would do to your children and for me, on the outside looking in, it would certainly do much more harm than good

pink-kitten's response was a very measured one and, ultimately, it has to come down to the happiness and sanity of your children. I don not know what age they are Motoko but if they are under 16 you are putting them at risk. And that is wrong....

It's very simple, you can be male or female and not feel as though you belong in that body. You can be gay or straight. Yes?
THEN if you have a sex change you can be the opposite sex to the way you were born and STILL be either gay or straight, it's really not that hard once you think about it.
So you are either ' gender straight' afterwards or ' gender queer' ( that is a term- not me being offensive) - regarding your sexual orientation.

Well, to answer all of your questions in one ogo. A transsexual is a person who is born with the opposite brain to their bodies. This is a phsiological fact.
Transfemales are born males but they are born with female brain structures hence why they feel like a woman " trapped " in a mans body, it is the same for Transmen, who are born with female bodies and male brain structures.

Regarding sexual orientation = If a Transfemale likes men, she is straight, for all intents and purposes Transfemales ARE women, we are just born with the wrong reproductive organs, that's all you have to think about it.
Anyone can be Straight,Gay,Bi wether they are genetic males or female or transmales or transfemales.

Eddie51 Please don't refer to me as a man, I am not a man. If I was a man, I would not be having a " sex change " this is the wrong terminology as I am not changing my sex. In order to do that I would have to have a male brain and a male body, I have a male body and a female brain, So I am having corrective treatment to get the body I should have been born with. This by the way is scientific fact. check the GIRES site out as they support the NHS.

So, my soon to be ex-wife admitted she had lied about the sexual abuse to her solicitor and then she informed me that she had informed her solicitor of this.

But you guys are right, I think this will do more harm and good, I guess i just wanted revenge for the double adultry she committed and the 25k pound debt she left me with and taking my kids 360 miles away from me and allowing me to only see them once every 6 months.

Pusskin - Yes I am Female, I have legally changed my name and in anothe 6 months I will sit before the GRC to have my gender legally changed to Female.

DTcrosswordfan - how am I putting them at risk ? Because I'm a trassexual. I was the primary carer and the primary worker in the family. My two children are both Autistic and for your information, when I left the family home, it was my wife who left used tampons on the bathroom floor and left human deficate on the floor also, she also decided to get absorbed in to second life and without noticing my littel girl had smashed a light bul and started layiung with the glass and slashed all of her hands. So if anyone is a risk to the kids, it is her, which I already warned social servies about and the court STILL gave her custody rather than putting them with a parent who happens to be trans.

EDDIE51 - Yes the governement officially recognises your new gender, you must apply to the GRC -gender recognition council ) you must have had hormone replacement therapy, a letter from your doctors and psychiatrist confirming diagnosis and that you will not return to your former gender and must have lived in a female role for two years. You no longer have to have surgery to your genitals to be recognised as a female or male. Some females live happily pre-op with their genitals intact, but they cannot use them because of HRT makes us unablr to have an erection.

Sorry but the OP's gender is completely immaterial. The question is:- my exwife lied to her laywer, social services and cafcass about sexual abuse.

Unless your ex wife perjured herself under other, I regret to say there is very little that can be done. The family courts are quite used to allegations being made left right and centre (and heck ex spouses regularly make all sorts of terrible allegations at each other). I have never yet known charges to be brought against a lying spouse.

Not what you need to hear - but if it goes to a full fact finding hearing, her credibility will be zero.
