At work today a friend (19) was talking about his girlfriend (17) and their sex life. I'll spare you the details, but basically she took some pictures of them together. Now the legal age for pornography is 18. (Sexual consent is 16 here, uk) If he possesses those images what are the implications? Basically everyone split onto 2 sides, 1 saying its illegal, the other saying that because it's of them together, and its not professional its between the two of them, and it's his girlfriend and not a girl he paid OR pictures he plans to make profit on... then it's fine.
Now I don't have any friends in legal advice so was wondering if anyone could settle this one for us...
Lol thanks, we we're talking about it for a good hour! I personally sided with the fact its intimate between the couple, and their documentation of their legal sex life is fine. Just my personal opinion though :)
If the guy has copies of those pictures in his possession, is it legal? because shes not 18 and cannot technically be in porn. although its not technically porn it's just a couples intimate photographs...
So you are enquiring about the legality of taking the photos or if these photos were to come into the wrong hands or maybe found there way on to the internet etc?
I'm not sure, I think TAKING them is legal, because it's him and her together as a couple... but i think HIM possessing them, technically possessing an image of an underage girl (underage with regards to pornstars being 18+) is where the legality issues lie...
lmao ^ I think a better way to look at this is: To qualify as child pornography, is it that the girl in the picture has to be under the legal consentual age (16, so in this case, with her being 17 its fine) OR is it that the girl in the picture isn't old enough to do Porn (18, so with her being 17 she's not old enough to do porn).
But then there's the argument these pictures arent proffesional and therefore not what we would traditionally call 'porn'... argh its a mental minefield!
Despite the 'law', I would doubt the police would waste their time on a 19 year old having suggestive/naked pics of his 17 year old girlfriend. What if they had married at 16? Imagine the farcical court case.

It's child pornography if under 18 .. In the posession of either party would result (if reported) in a police interview with them separately, mobile phones checked, etc .. in case they were distributing it, sexting, etc, etc .. possibly parents told .. and a warning .. on or off the record.
