Do spouses have to pay child maintenance to step children
4 Answers
Hypothetical question. My husband has a child from a previous relationship, he pays child maintenance (family agreement NOT CSA at the moment) hypothetically speaking if my husband were to give up work and stay at home and look after our two children, would I legally have to pay child maintenance to his ex's daughter (even though this child is not related to me neither did I "make" her). Rest assured this question is hypothetical ;-).
However on a similar vein, when I do start working (my children are 2 and 1 is just about to be born) would the CSA consider my earnings as well as my husbands?
The CSA are not involved at present but my husbands ex is always threatening!

If they did become involved they do not take your earnings into account when deciding how much maintenance needs to be paid but when they see if your husband can reasonably be expected to pay the whole of the amount calulated they do take your earnings into account. She could of course go for a court order which is a whole other ball game.
