My boyfriend is in court at the moment for assault.. Basically the 'victim' was attacking his brother who is disabled. He can't get up on his own and the 'victim was trying to kick and hit him. My boyfriend hit him on the shoulder with an aluminium garden chair. Quite light. Knowing that if on the shoulder it won't cause as much damage. The guy called the police before my boyfriend and they all 3 were arrested. This 'victim' is taking them to court for injuries. It is at crown court and jury making decision tomorrow. No CCTV and a couple of witnesses This would be his first time offence. He pleaded not guilty as he was protecting his brother. This happened a year and a half ago. Since this happened the 'victim' has been in prison twice for stalking and threatening behaviour including urinating on his ex girlfriends house and possessions. What do you think they will charge my boyfriend with if it is decided he is guilty.

As he is at Crown Court he must have an offence code that he is charged with.
EFor example section 20 or section 18 , let us know which code offence he is charged with. The possible sentence depends on the exact offence he is charged with.

I'm not sure. What would be the case under either sections?
Sorry for the delay, Section 18 is the more serious charge and is almost always a prison sentence. Section 20 is less serious and is normally a fine and or community service.
