my partner whilst he was married in 2008 went to abroad to live with his wife and two children.. un known to him his wife had already started an affair with a guy from the country they emigrated too as she had met prior to the family going out as she did some work out there, the marriage was rocky but she said the moved would re kindle the marriage.. they left the family home in the uk and rented it out. my partner took the last of hi saving £34000 left to him by his father.. once out there he furnished the new home bought vehcles etc..the money quickly went..she then asked him to move out..on the sunday and by the end of the week she moved her lover in.my partner was shocked as although he had been suspicous she insisted he was only a friend..a few months later my partner had to return to the uk as he did not have a work permit only she did.he had paid for her training so she could become qualifeid and he funded her trips out there to gain work experience etc he returned home upset and penniless..the tenants had to move out and he returned to the once family home.shortly after his returned she emailed him to say that she did not want anything from the house and wanted her name removed but if he sold the house forty per cent was to be put in trust for the children.. he sent form to have her removed from the morgage and she refused to sign..she then divorced him in 2010 and married her new man now in 2012 just after me and my three young children moved in with him she has sent solicitors letter demanding 50 per cent of the home or him to buy her out.. if he did this he has been told he would not be able to borrow enough to buy her out or get a mortage to be able to buy a house big enough for us all to live in .. any ideas.ps if he had known about her affair then obviously he would not have gone to the other side of the world to get ripped off by her..

Has he been to see a solicitor?
well was the family home a joint asset? If so, then she's probably entitled to half.
can you two get a place together? or rent?

he will go and see a solicitor soon but without legal aid he will not be able to fight this.. and yes it was a joint asset..and to be able to rent a house large enough we would be looking around the £1000 a month mark which is out of our reach.she never worked a paid anything of the mortage payments it just seems very unfair and she just want to totally clean him out his children live on the other side of the world and he feels very betrayed by her
morally she has behaved badly, however, morals have nothing to do with splitting assets. perhaps you could get a job, or if the children are young, get bunk beds and put them in together, so you'd only need a 2 bedroomed place?
ps, can they sell some of the furniture or vehicles he bought?
So who owns the house and vehicles abroad?
When they were divorced there should have been something worked out as to child maintenance surely. What are these letters now saying? Is she taking court action against him or just asking him for money?
There are a number of gaps in the information provided and it would help to know the following:

1/ Was the property in the UK owned by your partner and his ex-wife in their joint names and what is the approximate amount of equity in the property?

2/ If the ex-wife required no interest in the property why did she not co-operate in removing her name from the mortgage document, she now appears to require 50%, what does she want?

3/ What arrangements were made concerning the children of this marriage at divorce and is your partner the Father of the children?

4/ Were any financial arrangements made for the ex-wife at divorce?

5/ Are your partner and his ex-wife on speaking terms?

6/ Was the divorce under English law?


Sorry, but this type of information is important.

7. Was a property bought abroad? If so was it in joint names and who paid for it? Is it still in joint names? If not, whose name is it in and why did it change?
