what law covers removing cautions that i accepted at a police station ?

my solicitor has applied to have one removed from my record - how is this so ?

You generally can't get a caution removed, by accepting the caution you basically pleaded guilty to the offence you were cautioned for. see the last paragraph here.

yes it has been sent to the chief constable by my solicitor - i was not represented at the police station and i accepted it soley so i could get home to my daughter quicker - i did not even think that it was possible at all to get one removed - however my solicitor has applied ;-P

If this succeeds , and I hope it does, there will be many more wanting the same treatment. I have heard many cases of someone accepting a caution just to get out of the police station,including cases where the person has accepted a caution under pressure and threats of court charges unless they did. Please let us know the outcome.

This is the danger of hurrying you accept what you otherwise may not. The police are well aware that many people just want to get out of the police station as quickly as they can and I am aware of instances where people are told that if they wish to see the duty solicitor there may be a long wait (which can occur) so if you want to leave quickly this is not the best option and they will not have the duty solicitor available for an appointment using the argument that the person they wish to interview may not turn up.

There is a lesson here if you find yourself at the police station do not agree to anything on the basis that it is the quickest, if you wish to speak to the duty solicitor and there is a delay accept this and wait or you may regret your haste.

As far as I'm concerned, accepting a caution is an admission of guilt. If not guilty....don't take it and stand up for what you know is the truth. If you are guilty take the punishment.
