The limitations act should not be considered if you have a dishonoured cheque. If it is under £750 you can issue a statutory demand, which does not have to be issued by the court, and if not paid within 21 days the creditor can issue a creditor’s petition and apply to the court to make a bankruptcy order. If the cheque is for over £750 and the person appears unable to pay the creditor can apply to have the person made bankrupt.
