the death of my childs mother
15 Answers
my girlfriend and had a daughter august 08 2007, last week my girlfriend was killed in an automobile accident. I left the state like we had planned with our daughter now her parents are trying to get custody or visitation. Is it possible for them to do so? Also my girlfriends parents both have crazy charges like her mom has dui, child neglect, and child endangerment. And her father was a registered child abuser.

And on your childs first birthday too.
This is a UK site (hence the .co.uk in the addy) so its unlikely people here will be able to assist you. You need to find a solicitor who specialises in Family Law.

My heart goes out to you at this awful time xx.
I can only concur with what redcrx said -even in the USA each state seems to have their own legal sytem -I cant see why they would want to take your child away from you though -its not their place to raise your child. Is it possibly a kneejerk reaction after all they have lost their daughter and maybe are not thinking straight.
I do hope things work out -stay strong and take care xx

Like the first 2 posters, my sympathy to you in this situation. The advice redcrx gives about seeking legal advice, in this country the child would remain with the parent unless the grandparents could prove why it was detrimental, that would have to be the exception not the norm. Also, the child welfare agencies would also want to support you in caring for your child, so could provide you with support.

Seanshow85, I reckon you should do what your heart and mind are telling you to do, there is no reason that they should not have visitation rights , It is far better for you to come to an arrangement with them direct and stay with your daughter when they see her , when solicitors get involved it gets messy ! they don't have your best interests at heart , they just want your money!! Don't forget they too have lost there daughter and probably feel the baby is an attachment of her , after learning what background they have it may tail off anyway after a while , perhaps they are not the people to help you through this difficult time, you need help , I hope it all turns out for you and your daughter ..best of luck!
i was dealing with my lawers all day and with child protection services. Good news, the grandparents dont have any rights they would have to prove me to be a unfit parent. They cant do anything because i have a job, car, and my own apartment. This guy read my story in the paper and he is my nw lawer and hes free. i dont have any family to fall back on because i grew up in foster homes and thats been hard on me. but i have court in a week and i was assured i have nothing to worry about.thank you all very much for your posts and i will keep updated. thanks again sean paul

If you are just bf/gf, and not been married, you don't have the right to keep their grandson. But if you think for the child's custody, you may ask help from a child custodian adviser.
