I went into town and couldn't find anywhere to park so I parked in Halfords car park. When I got back I had received a ticket from them as their car park is for customers only.
My qestion is - do I have to pay. Legally is this enforcable?
Thanks
I know that it is extremely unlikely that the payment can be enforced for all the reasons given. However I'm puzzled as to why these car parking companies don't use clamping and then demand a large release fee since that does seem to be acceptable legally.
Factor, there is quite a lot of case law on the subject and whilst clamping on private land is lawful, until later this year, provided that the motorist has seen, and therefore can be taken to have consented to a warning notice of such consequences. The release fee must be reasonable and result in prompt release.
