What is the legal time that you must have between finishing work and going back in? My daughter works at a food establishment, she has been in since this morning, they are expecting her to work until midnight tonight and want her back in at 6am in the morning. Surely this is not right?

Rest breaks - a break during your working day

As an adult worker (over 18), you will normally have the right to a 20 minute rest break if you are expected to work more than six hours at a stretch.

A lunch or coffee break can count as your rest break. Additional breaks might be given by your contract of employment. There is no statutory right to 'smoking breaks'.

The requirements are:

the break must be in one block
it cannot be taken off one end of the working day - it must be somewhere in the middle
you are allowed to spend it away from the place on your employer's premises where you work
your employer can say when the break must be taken, as long as it meets these conditions

Daily rest - a break between working days

If you are an adult worker you have the right to a break of at least 11 hours between working days. This means as an adult worker, if you finish work at 8.00 pm on Monday you should not start work until 7.00 am on Tuesday.
Weekly rest - the 'weekend'

If you are an adult worker you have the right to either:

an uninterrupted 24 hours clear of work each week
an uninterrupted 48 hours clear each fortnight

I am with tinks on this one. I would have thought at least 8 hours would be the minimum required. In hospitals they call them 'late earlies'.

It's 11, I finish work most days at 8pm but one day a week I am back the next morning and sometimes if i have to do the news delivery i have to be in at 7am, it isn't really enough of a break when you consider a 30 minute drive to and from work and the fact that when we close at 8pm it is often 8.15 before i lock up due to putting cash away and doing staff exit searches etc, but it is only once a week and so i put up with it.
though i have to add i did at one point think it was 10 hours, when we do stock take it all goes out the window and if there is a call out overnight it also means it is wrong but as we are not paid for call outs anymore i guess it's a way round it.
