Should Deposit be refunded?

Last month my Dad bought a car off a dealer. When he drove the car home he discovered it was smoking from the exhaust so called the dealer who took it back to repair the following week and returned it to my Dad.

Dad then set off for a trip to Cornwall but felt like something wasn't right with the car so came off the motorway to stop at which point something went bang and leaked oil everywhere.

The AA towed the car back to the dealer at my Dads request. He then spoke to the dealer and told him he wanted a refund on the car as it was obviously full of problems. In the approx 2 weeks he owned the car he traveled around 23 miles in it himself.

The dealer immediately refunded my Dad the main cost but not the deposit, which was about £700 I think.

So, is my Dad entitled to a refund from the seller of the deposit considering the circumstances?

I should think so Evian, I would maybe check with Citizens Advice about it.

I hope so. Think he's going to try and see CAB this week. That's quite a lot of money to him.

It may be worth asking the dealer first- it may just be an oversight or he/she may be assuming you'll want to buy another car

The dealer won't return my Dads calls anymore.

My Dad did pop to the yard to try and speak to him but he wasn't there.

yes maybe because the 2 amounts were paid separately the computer just automatically refunded the one amount, and didnt link them, so its showing up as refunded.
