Are ADN in breach of contract
3 Answers
I took out a 2 year contract with ADN with cash back every 3 months of £60, this was to be paid in advance. The contract was £5.67 + VAT per month. It took 1 year and many phone calls to ADN and 3 mobile (service provider) to get my first payment of £240. 3 mobile charged me the full amount of £25 +VAT of which I paid. After 1 year I phoned ADN about the cash-back for the 2nd year and they said they were not liable to give me anymore cash-back after 1 year. This was not on the contract which clearly stated that the cash-back would continue or a better deal would be provided. I was fed up dealing with ADN and dealt with 3 mobile. They were adamant that I had a contract with them so I requested that they send me a copy of the contract, they could not so after 3 registered letters requesting the information I refused to pay the bill. They have block my phone and keep sending me every month a statement. This I have refused to pay. My question is :- Is ADN in breach of contract and does that result in the contract Null in Void. Thank you

Who are ADN? Some kind of phone retailer perhaps? No obvious answer at the top of a Google search.
I've no idea what you are paying 3 mobile £25 + VAT for, that seems to come out of nowhere? It certainly isn't a multiple of £5.67 + VAT.
I'm unclear about why you were getting a cashback of £480 on a contract that was going to cost £132 over 2 years? That makes no sense at all. Why would anyone effectively pay you £348 over two years to take their phone? Was it an incredibly expensive actual handset that you bought up front?
You presumably have a copy of this contract yourself since you say it "clearly stated" that cash back would continue? I don't therefore understand why there's any doubt about whether or not you have a contract with 3 mobile? Is it that they say the terms are different from your copy? In which case surely just sending them a copy of your version would solve the issue?
More info required here I think.
