at what age can a child in your care choose to live with the other parent
she is 13 yrears old and it is a loving home and she stayed with her dad for a week and now decided out of the blue that she is staying there and the ex is just letting he do her own thing which dont help matters
we have always had a close relationship with no problems

As residency (not custody anymore) has not yet been decided, the Court will decide if the parents cannot work it out between them. To this end, Cafcass will become involved and will interview both parents and the child (and potentially other agencies).

The child's views WILL be taken into account by the Court, however, they must also have regard to the "best interests" of the child. The more mature the child and the greater her understanding, the more the Court will take those views into account.
