Just ben on the phone to a company who in the middle of the conversation mentioned the call was being taped. I there a law requiring warning of the taping before it is taped?
I would add it was a pleasant conversation but I was just interested.
"Is there a law requiring warning of the taping before it is taped?"
No, not in the UK. It's legal to record the call as long as one party is aware that it's being recorded. (In other words, it's legal for either or both of the parties to record the call without notifying each other; it would be illegal for a third party to record the call if the other parties were unaware).
Do businesses have to tell me if they are going to record or monitor my phone calls or e-mails?
No. as long as the recording or monitoring is done for one of the above purposes the only obligation on businesses is to inform their own employees. If businesses want to record for any other purpose, such as market research, they will have to obtain your consent.
If the call involeves anything to do with data protection then yes they do have to infrom you.
A record of details which could identify you must be disclosed prior to the record being taken.
actually, both peter and rojash are correct and if the link is read properly everyone will see that but basically, it depends on what you are going to do with that recording
