why are some organisms in the animalia family and others are not?

The division of organisms into animals, plants, protists etc. is at the Kingdom level, NOT the Family level.

The classification of living things follows the following hierarchy:

Kingdom
- Phylum
- - Class
- - - Order
- - - - Family
- - - - - Genus
- - - - - - species

Some of these echelons also have sub-divisions such as sub-order or sub-family.

Animalia is one of the Kingdoms. All animals belong to this group. The other main Kingdom is the Plant Kingdom (to which plants belong).
