37d Gaoled is english spelling; jailed = US spelling

44a Assault. If it was to be assails then clue would have to be 'beatS up'
'beat up' can be ASSAULT but can't be ASSAILS as the clue would have to be 'beats up'.
I don't know regarding GAOLED and JAILED. Our spelling was always gaol (with Jail being the US spelling) when I was at school and I still see that used, so my preference would be GAOLED
