help car insurance and finance
my mum took out finance for me on a car two years later it was stolen.
although my mum took out the finance on the car the car was registered in my name and the insurance was in my name only as well as the gap insurance.
i informed my insurancecompany and they did an investigation and said they are ready to award the money but they have to pay the finance company first.
the problem im facing now is that the finance company wont accept the money from the insurance company as they need to verify it from my mum first. my mum left the country last year and although i have informed her to phone the finance comany of which she has the finance company are still refusing to accept the money and they wont give me a reason because im not the one who took out the finance. i informed my insurance company of this and they still refuse to pay me the money even though i was the one who took out the contract with them. my mum does not even have a licence.
i need to know what my options are? should i get a solicitor involved?
when i spoke to the insurance company investigator they informed me that the finance company should pay me directly and i should be the one to sort out the rest as the contract is between me and them and not my mum

For more on marking an answer as the "Best Answer", please visit our FAQ.I'm a little surprised by the finance company's actions here -I see loads of these scenarios (younger driver needs a parent to act as guarantor on the finance, or someone else takes out finance for them), and I've never had an issue like this before.
Most finance companies generally won't give a toss so long as they get paid - not a bunch of idiots like Welcome Finance is it by any chance?
I would have to ask though, why can't your mum just give them a ring? It'll only take five minutes to give her authority.

its capital bank and she has given both companies a ring.

Capital are normally very good - can't say I've ever had a problem with them.
I would have to ask what the hell your insurance company are doing here, as I really find it difficult to believe that the finance company won't accept payment for this agreement.
Quite honestly, I'm stumped - I've had problems where the company refuses to supply a settlement figure without the agreement holder's permission (which is fine), but I've never had one who refused to be paid?

That would mean more money, and possibly no result.
The only thing I could really suggest is that your mum needs to speak to the finance company to find out EXACTLY what the issue is.
If it's not them, get onto your insurance company, and tell them that unless a cheque is issued that day, you will go to the ombudsman and will be claiming compensation for the extra payments you have had to make.
