Brother Doing The Double, But Doesnt Care

my brother is doing the double 4 months now, he gave a false nat insurance number to company at start but 3 weeks ago he got his pay slip with correct ni number, he knows hes in wrong and get caught but wont sign off. what will likely outcome be, if he signs off now could he be ok if he pays back, will try get him to see sense as he is just after getting married etc and i dont want him jailed. he is greedy but i have tried to explain hmrc will catch up but he doesnt seem to care.

I don't know what doing the double means - do you mean he's drawing benefits but also working in paid work? He'll get caught and have to pay back all the benefit he's claimed illegally. People like him make me mad - the rest of us are paying towards his benefits.

he could still be prosecuted. using a fake NI number just adds to the dishonesty angle.

it would make more sense to carry on working, and stopping the fraudulent benefit claim.

Probably better to fess up, nd offer to pay the benefit money back, and hope that he doesn't end up with a criminal record. X

it's not HMRC, it's the DWP, and possibly his Local Authority if he's been fraudulently claiming Housing and Council Tax benefits too..

Checks are made against NI numbers so that it will show if NI has been deducted for employment whilst a claim for benefit is being made. HMRC won't prosecute but the DWP will and the longer it goes on the more he will have to pay back. If the overpayment is less than £2,000 and a prosecution is considered, he may be given the option of paying an additional 30% of the overpayment rather than be prosecuted.

Tell him to sign off on Monday and he might avoid prosecution,depends how much he's received in benefits while he's been working.

i have allready been onto him, he knows he will be caught but he seems to think he will get a slap on the wrist. personally i obviously dont agree with what he is doing, he states that all his friends are doing same and apparently they have been doing it for years. makes me mad too .
