It seems to be because the Prime Minister wanted the death penalty to show Britain how wonderful Thai justice is - against the wishes of the victim's mother.
Bear in mind that these men are illiterate and had no access to lawyers before confessing. I have do idea whether they are guilty or not, only that due process was not followed.
as mentioned it is usual for the death sentence to be reduced to life if there is an early confession and full cooperation with investigation, which is what these two did. If you go against this convention within the legal system there will be no incentive for criminals to confess that means more trials, more pain for the families of the victims and more change that the guilty will be set free by a court mistake or evidential problems... so i see that the death penalty in this case sends a strong message to the UK but sends a poor message to the Thai people under investigation
(and as an aside the death penalty is not a deterrent� oooer can�t believe I�m arguing about the death penalty again I MUST STOP� but not today)
