11 Answers
My ex husband of 3 years is currently on bail for sexual offences (marital rape) ended the marriage when he assaulted My 9 year old son from my first marriage.
He hit him and held him under the bath water in front of our 3 year old.( punishment)He also has physically assaulted him on several occasions leaving bruises. The Womens Refuge helped us escape and encouraged me to report him.
What is he likely to be charged with? AssauLt ? GBH ? Attempted Murder?
Is he likely to go to prison? Has previous violent criminal record.

Depending on the actual severity of the injuries, this looks like assault occasioning actual bodily harm, prima facie. And it deserves prison and I think that's what he'll get. The CPS know that he can get an adequate sentence for 'abh', even when, in reality, it is repeated abh on one victim. Jailing him will send a message to all other men who think that...

Attempted murder is a non-starter. It involves proving an intent to kill, unlike murder, which is invariably difficult. Curiously, it is much easier to prove murder because that only requires wounding or causing really serious bodily injury with intent to cause such serious harm, as a consequence of which death occurred.

There is only hearsay evidence as the matters are historic and my sons video interview. I was on scene in the immediate aftermath. Could he get away with this if he doesn't plead guilty? He has a long history of violence and also has sexual offences against 3 women - one of whom he tried to drown!!!
Hi, Bodicia, just a few words of caution, I can fully understand your need for answers but it is too risky to go into any specific details of this case on a public forum. The police and or Victim Support will accurately answers any questions you have and later the Crown Prosecution Service. Hope this helps.
Sorry to say but the Police will tell you everything is fine and they want him sent down BUT it goes to the Crown Prosecution service to decide and they want to know they will win a case or they wont prosecute him. They will ask, where is the evidence/physical proof now? Why didnt you call the Police at the time.
Best thing to do is get a restraining order ASAP and report him every time he come near you, befriend the nicest Police officer on the case then go directly to them each time and they will soon clip his wings for you.
