The legal limit for breath alcohol is 35 mcg and the reading puts your husband more than three times over that limit. The usual procedure is for police to take a blood sample and have this analysed. The limit for blood alcohol is (as has been mentioned) 80 mcg, making hubby just under one and a half times the limit. There is a different maximum level for urine alcohol (106mcg) but this is not often used.
If it was a blood reading, this is at the lowest end of the scale, and a ban of 12 months and a fine of half a week�s wages are the guidelines. If, however, it was a breath alcohol reading, then your husband is in for a shock. The Magistrates� sentencing guidelines for such a level (assuming this is a first offence) suggest a ban of 32 months but � more significantly � the reading is such that the justices are also bound to consider a custodial sentence. They will need to be convinced that they should come down to a Community penalty.
If this is the case then he should obtain legal advice forthwith as he has committed a serious offence for which he could be sent to prison.
