The legal limit is 80, so as Norman says (or barks perhaps), he was well over. That is assuming that you are in the UK. Other countries have lower limits.

In darkest Suffolk the going rate seems to 18 months ban plus a fine of about �200. This assumes that there are no negative factors to be added in e.g. car defects, no insurance, or other offences.

Are you sure, mollymo, that this was your husband�s breath reading? The legal limit for breath alcohol is 35 mcg and the reading puts your husband more than three times over that limit. The usual procedure is for police to take a blood sample and have this analysed. The limit for blood alcohol is (as has been mentioned) 80 mcg, making hubby just under one and a half times the limit. There is a different maximum level for urine alcohol (106mcg) but this is not often used.

If it was a blood reading, this is at the lowest end of the scale, and a ban of 12 months and a fine of half a week�s wages are the guidelines. If, however, it was a breath alcohol reading, then your husband is in for a shock. The Magistrates� sentencing guidelines for such a level (assuming this is a first offence) suggest a ban of 32 months but � more significantly � the reading is such that the justices are also bound to consider a custodial sentence. They will need to be convinced that they should come down to a Community penalty.

If this is the case then he should obtain legal advice forthwith as he has committed a serious offence for which he could be sent to prison.

Hi am new to the board and found this one straight away..........I have known people who have provided a breath sample reading this high..........it is not as uncommon as you think. 35mcg for breath, 80 for blood and 105 for urine(not used often for obvious 'collection' reasons!) are the legal limits in this country. In this instance, I would say he would probably get a two to three yr ban (depending on the mags on the day) and a hefty fine. His disqualification can be lowered if he is elegible to undertake the rehab course some mags offer though it usually only knocks about 3mths of the ban!
