Can I get out of my T Mobile contract

I took out a contract with T Mobile in February 2008 because I wanted a specific phone, and during the call we discussed my normal useage profile which included me spending time in France. I ended up with a contract for �35 per month which gives me �180 worth of services which is far in excess of what I would ever expect to use. However, on returning from France on Sunday I was confronted with a �232 bill - T Mobile have informed me that NONE of my European calls or texts are included in the �180 I have to use each month. The European limitations were never explained to me (or indeed even mentioned), and calls to customer services querying their selling of the contract have so far proved useless.

I also have an ongoing problem from day 1 with not being able to use my phone for picture messaging. This seems to be a network failure as my O2 sim works in the phone fine. I have spoken to customer services several times about this, and to their engineer twice to try to set the service up with no success, in my mind pointing to it being a network fault, not something wrong with the phone - could this be viewed as failure to provide a service?

I fully accept that I will have to pay the bill I owe but I am so disillusioned with the company that I would love to terminate my contract without being penalised. Has anyone out there got any advice for me? I know a similar question was answered by Stu Dent last year, are you still out there?

i dont think it could be viewed as a service failure, if you've been putting up with it since feb and onlt contacted them twice about it

TBH i think it's up to you to check that the phone contract does waht you want it to do. if european calls and limitations werent even mentioned i think you should have realised they werent included -

No, I have spoken to customer services MANY times about the picture messages and twice to the engineer ( a last resort for them) so I have not been remiss there. The original sales call might not have gone in to specifics but if you tell someone you are out of the UK a lot when you are discussing a phone contract am I being unreasonable to think they would have taken that in to account? This is their job!! They re supposed to be trained to match the customer with the service - and are we not members of the EU? It should not be us & them
i completely agree that tmobile are a buch of cowboy nitwits, however, i cant agree with you on the point of if they didnt say that the minutes/texts were inclusive of EU callsthen you should expect that they are. In my opinion its common knowledge that texts and call made to/from other countries are not included in bundles and are expensive extras. If the call did not go into specifics of limitations (in fact it was never mentioned) i cant see how you would expect it to be.
its like 0845 numbers - most people have to call them at some point but although they might not be mentioned, most people would assume they werent included in packages (which they are usually not)
