Taking Photos In Hospital

Last year I made a complaint about a wrong doing in hospital and my complaint was dismissed. I was told there is no way the wrong doing could ever happen.
In January this year it happened again and I took a film on my phone. I made a complaint in writing. A hospital bigwig and an IT techie turned up, transferred the film to a hospital laptop and then without permission deleted it from my phone.
I was then told that the manager in charge of the section where the wrong doing occurred had made a complaint about ME taking the film.
Notices have gone up saying anyone taking a photo or film will be prosecuted.
On the film there were NO members of staff or patients.
Does anyone know the legalities regarding taking photos/films?

Eccles.....guilt ?? Trying to brush Mrs o's complaints under the carpet, she has been given poor treatment on previous stays also...
It does seem like a bit of a knee jerk reaction with more than a hint of the bully boy about it!
Given the recent furore in the media about poor standards in hospitals and especially not listening to complaints, I suggest you contact your MP and possibly a good campaigning journalist. Watchdog on the BBC might be a good start, or You and Yours on Radio 4. Let the beggars have it. They have no rights over your phone and to have fiddled with it without your permission is foul play. If a school did this with a naughty child there would be hell to pay so why on earth does an NHS body think they are above the law?
And good for you Mrs O for making a copy. I'd advise you to make a copy of the copy on another device and hide it in your house somewhere. Just in case.

You have learnt now.

Your first stop is PALS and make sure your own complaint has been processed. You should make the point that you think that the mgr made the complaint in order to hinder your own. Ask for the Hospital's own harassment protocol and see if you have a complaint under that.

Photo the notice ( make sure your flash is off ) and no one is on the corridor when you do: [ clearly I have been doing this myself ] and then email the med director and chairman of the trust and ask what law they will prosecute. and copy your first complaint - pointing out that the denial of their minions was refuted by photographs

and finsih your letters by saying that they are here to help the tax payer and not to offend or oppress them - also to the MD mention ( whisper only) a reference to the GMC as he is not acting in the patients best intersests. [ hence your need to mention your first complaint ]

Sit back, wait and report here.

GMC - altho they used to have a dob-in-a-doc campaign, that is come to us first ! I am pretty sure they want you to have gone thro the hospital complaints system first, now

Email a copy of your complaint and the viddy to the chief exec and med director.

I retired before the photo notices went up. I would certainly ask under what legislation they are going to proceed

to the MD point out that GMC advice on patient communication is that the patient should be allowed to record doctor patient consultations and this appears to go against his GMC advice which he is NOT allowed to do.

I am unsure of the legality but we are told to ask people not to film or take photos in site, this has been the same for every company I've worked for.
From your original complaint you could go back 'dissatisfied' in the basis that what ever you complained about has not been rectified. This will make the hospital re investigate the complaint and then give you another report. If you are then unhappy with the report you can go to the Ombudsman. This is of course if you went down the 'formal' complaints route.
