Hi This Is An Update
Re common assault the person involved was pushed out of a shop by his mother after a few words he picked up a pot and dropped it to his feet and it smashed she says she was nicked on the leg he did not intend on hurting anyone and did not throw it at her the police were called he was charged with common assault but could this be accidentall he has pleaded not guilty and been told to make a statement of complaint about his mother

i.e. it's not necessary for the Crown to show that there was any 'intent' involved in the action that led to the charge being brought. It's enough to show that the defendant was 'reckless' (as, for example, by throwing a pot to the ground where there was a possibility of causing injury, even though that injury be unintentional).
